Importance of Will

Will is a document which proves that the testator intends to transfer his property upon death to certain other persons named in the Will. A Will is ambulatory; it speaks from the time of the testator’s death.

What is Will:

Will is a legal declaration of the intention of a testator with to his property, which he desires to be carried into effect his death. It includes codicil and every writing making a voluntary posthumous disposition of property. A Will can be changed by the executant as and when he so likes.

The Essential Characteristics of a Will are :

It mut be intended to come into effect after the death of the testator.

It must be revocable by the testator as and when he likes. If one does make a Will then his property will be inherited by his legal heirs in accordance with law of Inheritance applicable to him.
